General Terms and Conditions for Retail
These general retail terms and conditions (hereinafter referred to as the "Terms and Conditions") apply to contracts concluded through the Fingershop online shop.

As a seller and you as the buyer, the terms and conditions are as follows:
1. OVERVIEW
By means of a purchase contract, we undertake to deliver the goods specified in the order to you, and you undertake to take over these goods and to pay us the purchase price specified in the order. The purchase price includes the costs associated with the delivery of the goods and any fees associated with the selected payment method.
1.1 Does the sales contract only apply to the goods?
The purchase contract is any contract concluded under these Terms and Conditions, which can also include a service contract.
1.2 Is a sales contract a consumer contract?
A consumer contract is applicable if you purchase goods as a natural person outside the scope of your business activities. Otherwise, the General Terms and Conditions for Wholesale will apply to you.
1.3 What are your special rights as a consumer?
As a consumer, you have the right to withdraw from the contract, a 24-month warranty for unused consumer goods, the right to be provided with information before concluding a contract, and the right to an out-of-court settlement of a consumer dispute arising from a contract.
1.4 What governs our legal relationship?
Our legal relationship is governed by these Terms and Conditions, the Complaint Procedure, Terms of use of the website, and Czech law.
1.5 How do you agree to the Terms and Conditions?
By sending an order and also by confirming it in the web interface, you confirm that you have read these terms and conditions and agree with them.
2. PURCHASE CONTRACT
2.1 How do we conclude a purchase contract?
The web interface contains a list of goods, the presentation of which is informative. To enter into a contract, you must submit an order, and we must accept this order.
2.2 How to place an order?
You can place an order through the web interface, by e-mail, or by other methods as provided on the web interface.
2.3 When is the contract concluded?
The purchase contract is concluded when you receive an acceptance of your order from us, sent to your e-mail address. If this does not occur, the contract is concluded when you pay the full purchase price or take delivery of the goods.
2.4 Can you cancel an order that has already been sent?
You can cancel an unaccepted order by contacting us via phone or e-mail. Accepted orders are binding, and late cancellations need mutual agreement.
2.5 Can the price change?
Prices are valid as displayed in the web interface. Technical errors may occur, and we reserve the right to withdraw from a contract if prices are incorrect.
2.6 Do you have the option of obtaining the contract in text form?
The entire contract will be sent to you by e-mail or printed by post upon request.
2.7 What if you don't understand something in the contract?
Contact us by phone or e-mail with any questions about the terms and conditions or the contract.
2.8 In which languages can the contract be concluded?
The contract can be concluded in the Czech language unless agreed otherwise.
2.9 Is the contract stored somewhere?
We archive the contract (including these Terms and Conditions) in electronic form.
3. PAYMENT TERMS
3.1 What payment methods do we accept?
You can pay by cash on delivery or cashless before delivery via bank transfer.
3.2 When does the purchase price mature?
In cash, the price is payable upon receipt. For non-cash payments, it is payable within five days of order receipt.
3.3 What currency can you pay in?
Payment is possible in Czech crowns (CZK).
3.4 When can we require a deposit?
We may require a deposit, especially for orders over CZK 5,000.
4. DELIVERY CONDITIONS
4.1 How do we send your goods?
Delivery methods are specified on the web interface and can be chosen in the order.
4.2 What are the delivery costs?
Delivery costs depend on the size and nature of the goods, and are included in the final price of the order.
4.3 When will you receive your goods?
Delivery time depends on availability and the selected delivery and payment method.
4.4 How to proceed upon receipt of goods?
Check the package integrity upon receipt and report any issues to the carrier and us.
5. WITHDRAWAL FROM THE PURCHASE CONTRACT
5.1 How can you withdraw from the contract?
You can withdraw within 14 days of receiving the goods.
5.2 What are the consequences of withdrawal?
The contract is canceled, and any gifts received must also be returned.
5.3 When can you not withdraw from the contract?
You cannot withdraw from contracts for personalized or irreversibly mixed goods.
5.4 How will you return the goods to us?
Return the goods within 14 days of withdrawal to our delivery address. Do not send cash on delivery.
5.5 When will you receive your money back?
Refunds will be processed within 14 days of contract withdrawal, with costs related to your chosen delivery method deducted accordingly.
6. RIGHTS ARISING FROM DEFECTIVE PERFORMANCE
Your rights regarding defective goods are governed by relevant legal regulations and our Complaint Procedure.
7. FINAL PROVISIONS
7.1 What authorizations do we have?
We are authorized to sell goods based on a trade license.
7.2 How do we handle complaints?
Complaints can be addressed via our contact e-mail.
7.3 What are your rights in the event of a consumer dispute?
Consumers can seek an out-of-court settlement with the Czech Trade Inspection Authority.
7.4 What else should you know?
All correspondence will be carried out in writing via email, registered post, or personal delivery.
These Terms and Conditions are valid and effective from 23.9.2016.

1.1 The Terms and Conditions define the basic rights and obligations when concluding a contract through the web interface.
1.2 These terms are an integral part of the contract, and different provisions can be agreed upon in the contract itself.
1.3 The contract and terms are prepared in the Czech language.
1.4 These terms apply to buyers who are business entities and legal persons.
2. ORDER AND CONCLUSION OF CONTRACT
2.1 The web interface presents a list of goods, where ordering requires confirmation from the seller.
2.2 Orders can be placed via the web interface, phone, or email.
2.3 The seller is not obligated to confirm each received order.
3. DELIVERY CONDITIONS
3.1 The Seller is obliged to deliver goods properly packed and with necessary documents.
3.2 The Seller may arrange transport and insurance for which costs need to be paid by the buyer.
3.3 The buyer must check the goods upon receipt and report any discrepancies within two working days.
4. PAYMENT TERMS
4.1 Payment methods include cash on delivery and cashless bank transfer.
4.2 For cash payments, the price is payable upon receipt; non-cash payments are due within five days.
4.3 Interest may be charged for delayed payments.
4.4 The Seller may suspend further deliveries if payments are delayed.

5.1 The seller may withdraw from the contract anytime before goods are received by the buyer, with refunds processed accordingly.
5.2 Withdrawal by the seller is permitted if payment is delayed more than four weeks.
- RIGHTS ARISING FROM DEFECTIVE PERFORMANCE
6.1 Conditions for defective performance rights are governed by the Seller’s Complaint Procedure.
7. PROTECTION OF TRADE SECRETS
7.1 The buyer agrees to confidentiality regarding trade secrets disclosed during contract negotiations.
8. FINAL PROVISIONS
8.1 International relationships related to the contract are governed by Czech law.
8.2 Changes to the terms require written form.
